Is Bitcoin mining legal in India?

6 min read

Is Bitcoin mining legal in India? As of October 2026, no Indian law bans mining cryptocurrency. What India does have is a strict tax regime for virtual digital assets, high residential electricity tariffs in most states, and import duties that make mining hardware expensive. Put together, mining is legal but rarely worth it at home. This guide covers the legal position, how mined coins are taxed, a live calculator in rupees, what importing an ASIC involves, and why most mining apps and cloud mining offers in India are a bad deal.

This article is general information, not legal or tax advice. Rules can change, and a crypto bill has been discussed for years. Calculator results are estimates, not a promise of profit.

Short answer: no law bans mining, but it is taxed

India has never passed a law that prohibits mining. The Reserve Bank of India's 2018 banking restriction on crypto was struck down by the Supreme Court in 2020, and since 2022 the government has chosen to tax crypto rather than ban it. Mining equipment can be bought and run legally, provided you pay for the electricity you use and declare your income. A broader overview of crypto's legal status is in is crypto legal in India.

How mined coins are taxed: VDA rules, 30% and TDS on sale

  • 30% flat tax applies to gains from transferring a virtual digital asset under section 115BBH.
  • No deductions except cost of acquisition: electricity, hardware and internet are not deductible against VDA gains, and mined coins are generally treated as having no acquisition cost.
  • No loss set-off: losses on one crypto cannot be offset against gains on another.
  • 1% TDS is deducted when you sell above the threshold on an Indian exchange.

In practice, almost the entire sale value of mined coins can be taxed at 30%. Full explanation: crypto tax in India.

Electricity tariffs and why home mining rarely pays

Residential tariffs in most Indian states rise in slabs, and heavy users quickly land in the highest slab, often around ₹7 to ₹10 per kWh once fixed charges and duties are included. One modern ASIC draws about 3.5 kW, or 84 kWh a day, which is more than many households use in a week. Your distribution company may also require a higher sanctioned load, and running a miner on a domestic connection for a commercial purpose can breach the tariff terms.

Remember that the calculator shows running profit only. Divide the price of the machine by the daily profit to get a payback period, and keep in mind that network difficulty keeps rising and the next halving in 2028 will cut the reward in half. Importing ASIC miners: duty and warranty

ASIC miners are not manufactured in India, so they are imported or bought from resellers. Imports attract basic customs duty plus 18% IGST, and shipments can be held for classification checks. Manufacturer warranty is often void outside the original market, and repairs require shipping hash boards abroad or finding a local technician. Used machines are cheaper but less efficient, which makes the electricity problem worse.

Mining apps and cloud mining offers in India

  • Phone mining apps that promise Bitcoin are almost always ad apps or fronts for deposit schemes. A phone cannot compete with ASICs.
  • Cloud mining contracts that guarantee a daily return regardless of Bitcoin's price are a classic Ponzi sign.
  • Referral-driven platforms that pay more for inviting friends than for mining collapse when new deposits slow.

If an offer asks you to deposit money to unlock withdrawals, walk away and report it at cybercrime.gov.in or by calling 1930.
